The terms on which Kapson Globex, trading as Green Haven, quotes for and supplies cork products.
Who these terms are with
Green Haven is a brand of Kapson Globex, a business registered in Faridabad, Haryana, India. In these terms "we" and "us" mean Kapson Globex. These terms apply to greenhaven.eco and to orders placed with us, unless we have signed a separate written agreement with you, in which case that agreement takes precedence.
Quotations and orders
Most of what we make is quoted to its requirement, because price depends on quantity, branding method, finish and destination. For those orders a quotation is an invitation to order, not a binding contract, and the order becomes binding when we confirm it in writing and receive any advance payment we have asked for.
Some products are also offered online as fixed packs, at a published price for a set quantity. Those work differently: when you pay for a pack online, the order is binding at that point without a separate written confirmation from us. These terms apply to it in full.
Minimum order quantities apply and vary by product and branding method. We confirm the MOQ with your quotation. Online packs are sold only in the pack sizes shown on the page.
Prices, taxes and payment
Unless a quotation says otherwise, prices exclude freight, insurance, duties and taxes, which are quoted separately per order. Payment terms are set out on the quotation or invoice. We normally ask for an advance against custom and branded production, with the balance due before dispatch.
Online packs are the exception. Their prices are shown exclusive of GST, which is added at checkout, and they include freight anywhere in India, at one rate, with no delivery surcharge. Online packs are paid in full at checkout. Orders shipping outside India are always quoted separately.
Artwork and custom branding
Where you ask us to apply your logo or artwork, you confirm that you own it or are licensed to use it, and that applying it does not infringe anyone else's rights. You agree to cover any claim brought against us arising from artwork you supplied.
We produce against the artwork and proof you approve. Please check proofs carefully: once approved and production has begun, changes may not be possible and costs already incurred remain payable.
For online packs we send a production proof after payment, normally within one working day. Production starts only when you approve it. If we cannot produce a usable result from the artwork you supplied and you are not able to send us better artwork, we cancel the order and refund you in full before production begins.
If we do not hear back from you, your order simply stays open. We will chase you for artwork or for your approval, and nothing is made in the meantime. You can cancel under our Refund & Cancellation Policy at any point before you approve.
Lead times
Production typically takes 2 to 4 weeks from order confirmation and artwork approval, plus transit time. Fixed packs bought online are made within 48 to 72 working hours of artwork approval, with transit typically a further 3 to 6 days, and working hours excluding weekends and public holidays. Lead times are estimates given in good faith and are not guaranteed dates, and we tell you about any exception before you pay. We also tell you promptly if anything is likely to slip.
Cork is a natural material
Cork varies. Grain, tone and density differ between batches and between individual pieces, and that variation is a property of the material rather than a defect. Product photography and samples show a representative finish, not an exact match. Where an order needs close consistency, tell us before production so we can advise what is achievable.
Delivery, refunds and cancellation
Delivery is covered in our Shipping & Delivery Policy, and cancellation and refunds in our Refund & Cancellation Policy. Both form part of these terms.
Liability
We are responsible for supplying goods that match the agreed specification. To the extent the law allows, we are not liable for indirect or consequential loss, including loss of profit, contracts or business, and our total liability for any order will not exceed the value of that order. Nothing here limits liability that cannot lawfully be limited.
Governing law
These terms are governed by the laws of India, and the courts at Faridabad, Haryana have jurisdiction over any dispute.
